ORDER MODIFYING LICENSE (EFFECTIVE IMMEDIATELY) AND NOTICE OF VIOLATION AND PROPOSED IMPOSITION OF CIVIL PENALTY - $7,500

This is to inform the Comission that an Order Modifying License (Effective Imediately) and Notice of Violation and Proposed Imposition of Civil Penalty

'in the amount of $7,500 will be issued on or about June 26, 1990 to Mississippi-

'X-Ray Service,'Inc. This action is based on violations of requirements for industrial radiography that occurred on April 26, 1990 near Richmond, Virginia.

niississippi X-Ray Service, Inc. is a State of Mississippi licensee that~was operating in Virginia under the Part 150 General License reciprocity. The violations included failure to maintain proper surveillance of operations, failure to post radiation or.high radiation areas, failure to perform appro-priate surveys after each exposure, and failure to notify NRC three days 3rior to operating in a non-Agreement State.

In adcition, an Order Modifying t1e License (Effective Immediately)~ requires weekly notification to NRC of planned radiographic operations in non-Agreement States.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the. response, the civil penalty may be remitted,-
