ASSESSMENT OF FUTURE LICENSING CAPABILITIES i

This is to advise you that the Commission, with all Commissioners agreeing, has approved staff's plans to implement into the Five Year Plan the recommendations of the: Steering t

Group report on the Assessment of Future Licensing capabilities, subject to the following:

1.

The staff is directed to develop a three.part licensing milestone plan (LMP) with start and and dates clearly defined for those actions necessary for the NRC to be fully prepared to process a new license application.

i The LMP should incorporate the following and any l.

additional actions that the staff deems appropriates a.

Short Term (Start now):

i.

Identify the people with appropriate skills (internally and, if necessary, externally) and the organization / management structure c

that we would employ in the near future, if i

we were to receive a licensing application at an existing site for either a reactivation or a custom plant.

Revise siting requirements and guidance as appropriate.

This should be complete to support receipt of a site permit application in early CY 1991.

iii. Identify a small group to serve as'a focal point to assure that we continue to have the ability to process likely future license applications, iv. Revise 10 CFR Parts 20, 50, 73, and 100 as-directed by the Commission in the'SRM for SECY-89-036, dated 4/21/89 (copy attached),

regulations consistent with prior commission guidance.-

Continue efforts to revise 10 CFR 50, consistent with Commission guidance contained in the Five Year Plan (i.e., review existing regulations and guidance and modify or eliminate those of marginal importance to safety).

Refine the staff assessment in SECY-89-104 based on a best estimate assumptions, the updated planning base, and progress to date i

in implementing the LMP.

Include consideration 5

of innovative methods to improve the efficiency of our licensing and construction inspection / verification process.

For example, l

the time from issuance of a combined license until issuance of the-operating authorization is assumed to be 7 years based on past experience; however, efficiencies should come from having an

'3 essentially complete design prior to construction start.

In addition, the possible use of modular construction techniques and lessons learned from past construction experience could result in a substantial improvement over past experience.

Any significant difference between the assumed and actual construction time could have a significant impact on NRC's l

inspection / verification programs.

The staff should also consider the following items in its response to the above direction:

a. only minor consideration is given in i

SECY-89-104 to the need for organizational changes, primarily because the staff has focused on the DOE lower reference case.

Some advance consideration should be given to the possibility that the upper reference case could occur.

b. If the agency experiences the type of activity that would come'with the DOE upper reference case,.then substantial additional technical expertise could be needed that can only be developed over time.

The need for active recruitment, personnel training and the like should not be overlooked.

Identify the people with appropriate. skills, and the organization /wanagement structure we-would employ to process an application to operate a plant with a certified design at a preapproved site, should we receive one.

Staff should submit an update to SECY-86-284 describing, in greater detail, progress made since 1986 and the current program, including current schedule and resource estimates for identifying and modifying present regulatory requirements which have little or no impact on safety.

Annual reports to the Commission should be prepared, based on a formal review of our current planning base and the forecasts for construction of new nuclear plants, such that the information can be used to make timely decisions on resource needs for our Five Year-Plan.

The goal of these reviews would be to assure that the NRC is working with an up to date planning base and we remain ready to carry out our reactor licensing functions.
