Macktal v. NRC, No. 89-1034 (D.C. Circuit)
-1 Petitioner Joseph Macktal sought intervention in I
the Comanche Peak proceeding.
The NRC denied his motion and Mr. Macktal sought judicial review.
On j
June 11, 1990, the D.C.
Circuit dismissed his case which challenged aspects of two Commission orders, CLI-88-12 and CLI-89-06.
First, the Court held
]
that Mr. Macktal's case was filed before the i
Commission issued CLI-89-06.
Therefore, his challenge to that order was premature.
- Second,
{
the Court held that the decision by the Secretary of Labor invalidating various provisions of Mr.
Macktal's disputed settlement agreement with Brown
& Root mooted his claims regarding the Commission's decision in CLI-88-12.
Mr. Macktal's lawsuit was previously reported in Litigation j
Report No. 1989-3, SECY-89-035.

Macktal's petition for review was filed prior to the issuance of Texas Utillties Electric Co,
29 N.R.C. 348 (1989D, the order denying his motion for intervention.
Dism;.ssal for lack of subject matter jurisdiction is appropriate under such circumstances.
