MEMORANDUM OF UNDERSTANDING WITH THE DEFENSL NUCLEAR FACILITIES SAFETY BOARD
Purpose:
To request the Consnission approve the Memorandum of.-
Understanding (MOV) with the Defense Nuclear Facilities Safety Board-Discussion:
The National Defense Authorization Act for FY 1989 established a Defense Nuclear Facilities safety Board (hereafter referred to as the Board) to review and evaluate Department of Energy defense nuclear facilities. Section 313(f) of the Act provides for the Board to obtain advice and recommendations at-the staff of the NRC and the ACRS on matters pertaining to the Board's responsibilities, with the-consent of and under appropriate support arrangements with the NRC.
The Act also allows the board to "use any facility, contractor, or employee of any other.departnent or agency of the Federal Government with the consent of and uncer=
appropriate support arrangements with the head of such department or agency..."
The Board has expressed interest in receiving technical and administrative assistance from various NRC organizations in areas'such as technical safety issues, contracting, security, drug testing, and ACRS support. This paper transmits an umbrella MOU which would provide the broad framework for interactions between the NRC and the Board. As the need arises, appendices for specific agreements for each area of interest will be added.
A copy of the proposed MOU is enclosed.
This MOU has the concurrence of the Office of the Inspector General. The Office of the General Counsel has no legal gra f.;O) objection. The Board has also indicated their agreement to sign the MOU.
