Dear Mr. Rhodes:
We have been advised by our Region I office that devices containing 10 mci Ni-63 sources have been shipped from your company to companies in the United States.
No licenses for possession and use of such devices in the United States have been issued by the NRC. Therefore, Gasby Analytical is not generally licensed under NRC regulations in Title 10, Code of Federal Regulations, Part 110 to import the devices for use by NRC domestic licensees.
Further, no other persons or companies have been issued a specific license to import such devices.
You are requested to stop all shipnents to the U.S. until the devices have been licensed for use in the United States.
If you wish to pursue use of the devices in the U.S., you should request a sealed source device review by the NRC. The person to contact for further information is Mr. Steven Baggett, U.S. NRC, Office of Nuclear Material Safety and Safeguards, Medical and Commercial Use Safety Branch, Mail Station 6-H-3, Washington, D.C. 20555.
