July 21, 1982 MEMORANDUM (Motion Regarding Rebuttal Witnesses on Criticality Contention)
Af ter reviewing Christa-Maria et al.'s (Christa-Maria) liotion Regard-ing Rebuttal Witnesses on Criticality Contention and the responses of the NRC staff and of Consumers Power (whose counsel are excused for late-filing, on this one occasion, because of competing business), we have decided that this motion is not yet ripe for determination.
The hearing on criticality issues has been completed pursuant to a schedule developed to permit the Board to act efficiently by issuing separ-ate opinions on completed issues. While this general plan may be laid aside for important reasons, more must be shown than that there is antbiguous or conflicting testimony in the record.
We note, however, that the criticality contention is hotly contested and is of great potential importance to the safety of the proposed increase in spent-fuel storage capacity.
Consequently, Christa-Maria may have until August 9, 1982, to identify one or more witnesses and to provide sufficient detail about their testimony so that the Board will understand the impor-tance of keeping the record open.
Other parties may respond to a timely motion within 10 days of receipt.
Should Christa-Maria fail to file a timely motion, the hearing on the criticality contention will be considered complete.
