MEMORANDUM AND ORDER (Concerning Schedu'e for Further Proceeding)

In a motion filed on May 17, 1982, the Applicant has proposed a schedule for further proceedings in the above-identified matter.

The Staff has joined the Applicant in moving the Board to adopt the proffered schedule. With slight modifications, the State of Maine would also agree with the schedule proposed by Applicant.

In its response dated June 1, 1982, Intervenor, Sensible Maine Power (SMP) has registered several objections to the proposed schedule. More specifically, SMP has urged the Board (1) to order simultaneous discovery upon all contentions in this case, coincident with its ruling upon the

admissibility of Environmental Impact Appraisal (EIA) and Safety Evaluation Report (SER) contentians; (2) to compromise the proposed discovery periods at 120 days; and (3) to adopt a statement expressly recognizing and governing delay or disruption in the discovery schedule.

The schedule set forth below, is generally respcasive to the specific requests of SMP.

It provides sufficient time for the orderly completion of this proceeding in a timely manner. No need is seen for the adoption of a statement regarding delay or disruption of the schedule set herein.

If, for unexpected reasons, the schedule cannot be held to, the Board, in consideration of the needs of the parties, will take appropriate action.

For the foregoing reasons and in consideration of the entire record in this matter, it is this 20th day of July, 1982 I
