This will acknowledge your letter dated June 25,1982, on behalf of Omaha Public Power District concerning the assessment of fees for the Fort Calhoun, Unit 2 withdrawn construction permit application. As you are aware, the matter of as-sessing fees for withdrawn applications is now before the U.S. Court of Appeals, First Circuit for decision. Therefore, we intend to withhold any action on your request regarding the matter of fees for the withdrawn application until the Court renders its decision.
