Dear Chairman Palladino:
Please find enclosed a letter to the Commissioners on behalf of the Power Authority of the State of New York (Power Author-ity).
It addresses issues raised by the Draft Memorandum and Order distributed prior to the July 9,1982 Commission meeting regarding the status of the Indian Point proceeding.
Although 10 C.F.R.
S 9.103 (1982) states, in part,
[s] tatements of views or expressions of opinion made by Commissioners or NRC employ-ees at open meetings are net intended to represent final determinations or beliefs.
Such statements may not be pleaded, cited, or relied upon before the Commission.
except as the Commission may direct, the Draft Order is not such a statement.
It is not part of the transcript of the July 9 meeting and is not intended to represent

Accordingly, the Draft Ordec is cited in the enclosed letter.
However, if the Commission were to determine that its regu-lation applies to a draf t order, the Power Authority requests that the regulation be waived due to "the unusual factual circum-stances present here."
