SUA SPONTE ISSUES IN CINCINNATI GAS &

ELECTRIC COMPANY, ET AL. (WM. H. ZIMMER NUCLEAR POWER PLANTT DOCKET NO. 50-358 This is to inform you that the Licensing Board presiding in the above proceeding has exercised its authority pursuant to 10 CFR 11 2.718(j) and 2.760a to reopen the record and raise sua sponte eight new contentions that were initially advanced by the Miami Valley Power Project, an Intervenor in this pro-ceeding. These contentions relate to quality assurance practices at the Zimmer Station and Cincinnati Gas & Electric Compan'y's character and competence to operate a nuclear station.

We have exercised our sua sponte authority to raise thc;a issues because we do not believe MVPP has made a strong enough showing under the Rules of Practice to entitle it to introduce late contentions and because we believe that resolu-tion of these serious safety concerns on the record and in full public view would be in the public interest.

Our Memorandum and Order which sets forth our reasoning is attached hereto. The contentions are set out in an Appendix to that Memorandum and Order.
