Dear Barbara:
This is to confirm the agreements which we discussed during the telephone conversation which you initiated at about 9:30 P.M.
last night.
First, as a result of a mixup whereby NRDC did not arrange for a reporter, the deposition of Messrs. Anderson and Longenecker previously scheduled for 8:00 A.M;:Bri $une 15. ;
could not be taken.
Second, as a result of the circumstances noted above and the difficulties of rescheduling, NRDC is withdrawing its request for this deposition.
Third, while the Applicants were inconvenienced and unnecessarily incurred travel costs for Mr. Anderson, t-he Applicants will not pursue cost reimbursement.
This closes out the last remaining outstanding item
' in regard to NRDC's discovery versus the Applicants.
I appreciate your candor in bringing the matter of the deposition to my attention and your cooperation in reaching an amicable resolution.
