Dear Mr. Saltzman:
Attached find a copy of the Summons and Complaint which.was furnished to us by the Georgia Power Company, a defendant in the captioned suit.
This claim involves a suit on behalf of three employees who allege radiation injury and resulting death, (in two instan-ces) as a result of radiation exposure while they were working for the Pullman Kellogg Corporation at the Georgia Power Company Edwin I.
Hatch nuclear facility in Baxley, Georgia.
l The deceased employees are James Benny Sizemore and Clifford l
Kenneth Osteen, Jr., while the third claimant is Percey Frances Kelly, Sr. who is reportedly presently near death because of health problems related to cancerous brain tumors.
We expect to participate in this litigation on behalf of our policyholder, Georgia Power Corporation but, as you know, our policy does not cover the codefendant, the United States,g\\gp of America and we will not, therefore, respond on their behalf.

~ July 7, 1982 It'is'my understanding that, although the Summons and Complaint have not been-served upon Georgia Power Company,.
the court has already scheduled a deposition on July 7, 1982, at the Florida home of Percy Francis Kelley.
This-unusual pre-Summons discovery has been scheduled because of the serious health problems of Mr.-Kelley.
