Dear Mr. Chairman:

This pertains to the Commonwealth of Massachusetts' pe-

.tition to intervene in the Commission's pending civil penalty.

proceeding regarding alleged violations of NRC reculations by

.the Boston Edison Company at the. Pilgrim 1 Nucle.a-Generating Station (E. A'.

i81-63; Docket No. 50-293; License Ko. DPR-35).

As you'know, on January 18, 1982, the Director of -le Office of Inspection and Enforcement proposed the imposition of a $550,000 civil penaltv on the Boston Edison Companv. for '._he alleged vio-lations.

It is my understanding that NRC. staf f is reviewingthe

o. ct'ition.of the Massachusetts Executive Office of Enerc.y Resources'.

' (EOIR) requesting the use of the $550,000 fine for a. home weather-ination/ conservation program, and that such expendit'ure would be in lieu ~of final imposition of the proposed penalty or in fulfill-ment of the penalty obligation.

EOER contends that NRC has the authority to grant the request under its genera 2. power to "cor-remit, or mitigate" the crocosed oenalty.
