SECY-82-133 AMENDMENTS TO 10 CFR CHAPTER I, PARTS 19, 30, 40, 50, 60, 70 AND 150 WITH RESPECT TO EMPLOYEES WHO PROVIDE INFORMATION The Commission, by a vote of 4-0 (Commissioner RobertE abstaining)*, approved a final rule to implement Section 210

" Employee Protection" of the amended Energy Reorganization Act.

The Commission requested that:

a.

The rule be revised:

1.

To modify the format of NRC Form 3 by entitling the section on discrimination " Employee Protection."

(See attached) 2.

To reflect in the Comments on the Proposed Rule section that a rulemaking is in progress to require contractors and subcontractors to post NRC Form 3.

b.

The rule be published in the Federal Register.

Copies of the FRN and of the revised NRC Form 3 be distributed to:

  • Section 201 of the Energy Reorganization Act, 42 U.S.C.

Section 5841, provides that action of the Commission shall be determined by a " majority vote of the members present."

Commissioner Asselstine was not present when this item was affirmed, but had previously indicated his approval of it.

Had Commissioner Asselstine been present, he would have affirmed his prior vote.

Accordingly, the formal vote of the Commission was 3-0 in favor of the decision.

Junn 17, 1982 FOR AFFIRMATION THURSDAY, JUNE 17, 1982 SECY 82-133 AMENDMENTS TO 10 CFR CHAPTER I, PARTS 19,30, 40,50,60,70, AND 150 WITH RESPECT TO EMPLOYEES WHO PROVIDE INFORMATION The Commission is being asked to approve a final rule to implement Section 210, " Employee Protection," of the amended Energy Reorganization Act.

Chairman Palladino and Commissioners Gilinsky and Asselstine have approved the rule with a modification by Commissioner Gilinsky that would alter NRC Form 3 by entitling the section on discrimination " Employee Protection."

Commissioner Roberts abstained.

The Commission has also agreed to direct staff to promptly submit a proposed rule requiring contractors and subcontractors to post NRC Form 3.

We have been informed that Commissioner Ahearne will be voting to approve, although he would have preferred to withhold consideration of this rule pending receipt from staff of the proposed rule regarding contractors and subcontractors.
