Units 1 and 2 ) July 2, 1982 MEMORANDUM AND ORDER IN RESPONSE TO PETITION TO INTERVENE (1) BY COLUM8IA RIVER INTER-TRIBAL FISH COMMISSION; (2) BY CONFEDERATED TRIBES AND BAND OF THE YAKIMA INDIAN NATION Under the name of the Columbia River Inter-Tribal Fish Comission a petition to intervene has been filed. The petition states that S. Timothy Wapato represents the Comission and that the Comission consists of the fish and wildlife comittees of four Columbia River tribal governments, i.e. (1) Confederated Tribes and Bands of the Yakima Indian Nation; (2) Nez Perce Tribes of Idaho; (3) Confederated Tribes of the Umatitla Indian Reservation; and (4) Confederated Tribes of the Warm Springs Indian Reservation.

The petition is techr.ically deficient in the following ways:

(1) The petition has not been executed by S. Timothy Wapato as provided on page 12 thereof.

(2) No date is shown thereon.

(3) Statement that S. Timothy Wapato is authorized to execute the petition dated May 5,1982 is signed by one James B. Martin for S. Timothy Wapato - authorization for Wapato to sign for the four tribes and similarly authorization for James B. Martin to sign for S. Timothy Wapato is needed.

(4) Supplement to Petition to Intervene of Columbia River Inter-Tribal Fish Commission is also improperly signed.

(5) Authority of Columbia River Inter-Tribal Fish Commission to sign for the four tribal governments is needed.

(6) It does not apear that the " Fish Commission" can represent Confederated Tribes and Bands of the Yakima Indian Nation since the Yakimas have filed a petition to intervene on their own.

Accordingly, it appears necessary that the " Fish Commission" submit

copies of the authorization that it has to represent the Confederated Tribes and Bands of the Yakima Indian Nation.

! (7) The acceptability of the " Fish Commission's" contentions set forth in the Supplement to its Petition to Intervene will be dealt with as soon as the deficiencies in the execution of the

petition are cleared up and the late filing question is resolved.
