In the Matter of Consumers Power Company (Big Rock Point Nuclear Power Plant), Docket No.
50-155-OLA (Spent Fuel Pool Modification)
Gentlemen:
Consumers Power Company (" Licensee") has considered the suggestion of the Licensing Board concerning the possibility of reorganizing the information in Consumers Power Company Exhibit No. 5 so that the " emergency" information appears at the beginning of the pamphlet.
(June 28, 1982 Telephone Conference, Tr. 2629-31.)
The Licensee has advised counsel that it will undertake to be responsive to the Board's request.
The editing of the material is presently underway and the exact nature of the revision or revisions is not available at this time.
Counsel expects to be able to provide specific advice next week.
In sum, Licensee will attempt to implement the Board's suggestion, and requests that it be given until next week to provide the specific changes for review by the Board and the parties.

Shon July 2, 1982 Page 2 Licensee is attempting to reconcile this matter through accommodation, and this action is being taken without prejudice to its position on the question of whether or not it is appropriate for the Board to exercise its sua sponte powers.
Licensee expressly reserves the right to oppose, in the future, the exercise of such powers by the Board should the resolution of this matter through " accommodation" fail.
