Dear Mr. Knighton:
This is in response to ycur letter of March 17, 1978, addressed to my attention.
On June 17, 1977, our licensing counsel advised the Atomic Safety and Licensing Board of the commencement of a lawsuit against Omaha Public Power District by Nebraska Public Power District. Since then, Westinghouse has also filed a suit against OPPD for breach of contract. Settlement or disposition of the two lawsuits will influence, if not control, further decisions by OPPD concerning possible future use c of the Fort Calhoun site.'
l We therefore request that further licensing activities in the above docket be held in abeyance until OPPD notifies the Regulatory Staff further concerning the progress of the litigation.

Docket No. 50-548 OMAHA PUBLIC POWER DISTRICT (Fort Calhoun Station, Unit 2) )
REQUEST FOR WITHDRAWAL OF APPLICATION On February 1, 1977, the Board of Directors of Omaha Public Power District (" Applicant") voted to cancel all contracts for the construction of Fort Calhoun, Unit No. 2.
By letter dated May 5, 1978, Applicant asked the Atomic Safety and Licensing Board to hold in abeyance further proceedings with respect to the application for a construction permit for Unit 2. Applicant has now determined that no useful purpose will be served by continuing this proceeding, that its application should be withdrawn, and that the proceeding should be terminated.
Because a notice of hearing on the application has been issued, this request for withdrawal is being submitted to the Atomic Safety and Licensing Board.
Pursuant to 10 C.F.R. I 2.107,. Applicant hereby requests permission to withdraw its application for licenses without any prejudice to Applicant or its right to apply .for utiliza-

tion facility licenses at a future date.
