Dear Mr. DeYoung:

We have your letter of May 18, 1982, the Appendix titled EVALUATIONS AND CONCLUSIONS, and ORDER IMPOSING A CIVIL MONETARY PENALTY, While we may remain in substantial disagreement with some of your conclusions, particularly the statement that Dairyland Power Cooperative has "a poor record of adherence to procedures," rather than pursue this matter further, we prefer to devote our available resources toward carrying out our responsibilities for safe and efficient operation of our nuclear facility.

The procedures which led to the imposition of the civil penalty are i

the subject of ongoing discussions with the Region III director. While we hope that these discussions will lead to NRC approval of improved procedures, we will, of course, follow the direction of the NRC as to current procedures until such approval is obtained. Accordingly, we
