NEW YORK STATE'S MOTION FOR WAIVER OF FILING RULES FOR EXHIBITS New York State proposes to file as an exhibit in this pro-ceeding in the New York State Radiological Emergency Preparedness Plan for the Indian Point Plants.

Since that document is the subject of f
contention in this first phase of the proceeding on Commission Questions I

Three and Four, it is hard to see how it is possible to move forward

without making it an exhibit.
However, that document is voluminous, i
very expensive and there are a limited number of copies available of E
E the County portions of the Plan.

would require filing of copies upon all parties and six copies upon the Board and Secretary.
We believe that parties interested in emer-gency planning have access to this material since copies were provided g
to those persons requesting them and to public libraries.

That it be allowed to file 4 copies of the State Plan and the Orange County and Putnam County portions of the
{E plan with the Board and the Secretary (1 copy to Judne Carter, 1 copy to Judges Shon and Paris and two copies to the Secretary) at this time.

That 2 copies of the Rockland portion of the plan be provided to the Judges at this time (1 to Judge Carter, 1 to Judges Shon and Paris).
(3)
Thdt 2 additional copies of the Rockland Plan will be provided for the Secretary and copies of the Westchester Plan will be provided for the Secretary and the Judges before the commencement of the adjudicatory hearing.
(4)
That a copy of the complete State Plan will be available at the hearing.
(5)
That the State be relieved of the obligation of filing copies of the Plan upon all parties.

ORDER RULING ON NEW YORK STATE'S MOTION FOR WAIVER OF FILING RULES FOR EXHIBITS New York State by Motion dated June 8, 1982 has moved for waiver of the rules governing the filing of exhibits (10 CFR E2.743 (f).
New York State claims that it is burdensome to comply with these rules for the filing as an exhibit of the New York State Radiological Emergency Plan for the Indian Point sites.
For good cause shown the State's motion will be granted.
It is, this day of June, 1982, hereby ORDERED That, New York State's Motion for Waiver of Filing Rules is granted.
