Withholding Infomation fron Public Disclosure - Improved Themal Design Procedores (CAW-82-15) - Byron /Braidwood By your application, dated May'5,1982 and affidavit AW-76-60 you submitted a response to NRC. questions on Improved Thermal Design Procedures for the Byron /Braidwood Stations and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790.
Your reasons (or requesting our withholding this infomation from public disclosure were that the improved thermal design procedure is of significant ccmercial value to (1) perfom and justify analyses which are sold to customers and (2) to sell the analysis services based upon the experience gained and
, the nethods developed.
Public disclosure of this information concerning design procedures could cause substantial ham to the competitive position of Westinghouse since competitors could utilize this infomation to justify their own designs without expending similar sums of money and manpower to develop the informtion.
We have reviewed your application and material based on the requirements and criteria of 10 CFR 2.790 and have determined that the above-nentioned document sought to be withheld contains trade secrets or confidential, proprietary comrercial information.
We also have found at this time that the right of the public to be fully apprised as to the bases for and effects of the proposed action does not outweigh the demonstrated concern for protection of your competitive position. Accordi ngly, we have determined that the information should be withheld from public disclosure.
We therefore approve your request for withholding pursuant to Section 2.790 of 10 CFR Part 2 and are withholding the Westinghouse Improved Thermal Design Procedures submitted by letter, dated May 5,1982, from public inspection as proprieta ry.
