Waste Compact (except North and South Carolina) have enacted their enabling legislation into law and have become parties to the Compact.

North Carolina legislature will not convene until June 6,1982.

I Representatives from NRC attended the annual meeting of the Conference of Radiation Control Program Directors, May 24-28, in Portland, Maine.

NRC is using this opportunity to meet with their Regional State Liaison Officers to discuss subjects such as emergency planning, high-level waste, NGA's evaluation of the Agreement States program and NRC's progress toward regionalization.

The NRC has been asked by the U.S. Department of Energy to review its draft status report, " Low-Level Radioactive Waste Compacts," prepared in response to a request from Senator James A. McClure, Chairman, Committee on Energy and Natural Resources. The draft DOE report is also being sent by DOE to all States and other Federal agencies for comment.

The NRC participated in a full-scale emergency response exercise with the Arkansas I nuclear power plant on May 19, 1982. Thr. drill was designed to test both the State's and the NRC's procedures for appropriate notification and response should an accident at the site occur.

CALIFORNIA Low-Level Waste Disposal A-1513. Requires the Department of Health Services to develop a plan for the management, treatment & disposal of low-level radioactive waste. Permits the Department to establish and operate or contract for operation of facilities for interim storage of the waste. (Enacted 3/2/82.)

Radiation Control A-1514 Makes violators of the Radiation Control Law liable for civil penalties of up to $5,000 a day.

FLORIDA Southeast Interstate Low-Level Radioactive Waste Compact H-1066.

Enacts and enters the State into the Compact for the purpose of providing a cooperative effort among States for disposal of low-level radioactive waste.

IOWA Energy Policy Council H-2373. Relates to the continuation of the activities of the Energy Policy Council.

Changes the requirement for a report identifying trends of energy supply, demand and conservation from

recognition for various categories of innovative energy conservation.

The appropriation for the Energy Policy Council for FY'83 is $413,425.

KENTUCKY Disposal Siting Board S-279. Creates the Kentucky Regional Integrated Waste Treatment and Disposal Facility Siting Board, whose members will be appointed by the Governor. The Board's powers will include processing applications, adopting regulations, and issuing certificates of environ-mental safety for the siting of a hazardous waste facility in the State.

While issuing the certificate, the Board will take into consideration social and economic impact, location, and the relationship of the proposed facility to any State-owned commercial low-level nuclear waste disposal site.

2 MAINE Public utilities Commission LD-2119.

Requires Public Utilities Commission approval for the purchase of portions of electrical generating facilities by electric companies or fuel conversion in electrical generating facilities. (Enacted 4/13/82.)

Decommissioning LD-2124 Ensures funding for the eventual decommissioning of any nuclear power plant.

Requires licensees operating plants to place these monies in a separate trust fund to be invested by a trustee until they are ready to be used.

VIRGINIA Emergency Preparedness Fees A-18.

Owners of nuclear power plants must pay the State Office of Emergency Services an annual fee of $85,000 to support activities related to the development and establishment of emergency plans to deal with nuclear accidents.

Uranium Minings S-179.

Encourages & promotes the safe and efficient exploration for uranium resources and assures that uranium mining and milling will be subject to regulations which protect public health and safety.

Details permit fees, application requirements, plugging procedures and penalties.

Requests that Congress and the President oppose legislation, S-1606 and HR-5963, which would require all licensed nuclear electric utility systems in the country to share in the cleanup costs of the accident which occurred at Three Mile Island on March 28, 1979 (Adopted 4/29/82.)

TENNESSEE Clinch River Breeder Reactor SJR-205. Adopts as the official State policy, the position that the CRBR project should be completed as quickly as possible, and that site preparation should commence without further delay.

KANSAS Energy Advisory Council H-3156. Establishes an Energy Advisory Council within the Energy Office, empowered to approve any amendments to the State Energy Conservation Plan which are required by DOE or other federal agencies for participation in the State Energy Conservation program.

MASSACHUSETTS Co_nsumer Utility Board S-1841.

Establishes the Consumer Utility Board for the purpose of adequate representation and protection of consumer interests in utility affairs and to provide for consumer control of and responsibility for the actions of the corporation. Members will consist of all residential consumers who contribute a minimum of $5.20 to the organization during the corporation's fiscal year.

Public Utilities Charges H-5928.

Prohibits the Department of Public utilities from allowing utility companies to charge their customers for certain costs relating to the development of unlicensed and cancelled nuclear power plants.

MICHIGAN Midwest Interstate Low-Level Radioactive Wasta Compact H-5600. Would enact the Compact and enter the State into it as a party, to provide for the regional management of the disposal of low-level waste.

I NEW YORK Decontamination and Decommissioning A-174 Establishes sinking funds for the decontamination and decommissioning of nuclear power plants to ensure financial resources are available for removal of environmental and public health hazards. Revenues will be established from the sale, transmission and distribution of power by nuclear facilities.

Reactor Simulators A-810. Would require a simulator duplicating the nuclear reactor control room to be located, for training purposes, within three miles of each nuclear facility.

Requires that each plant operator spend a reasonable amount of time each month in training.

Would appoint a nuclear plant safety monitoring officer for each power plant operating in the State. The officer will identify potential operating conditions which may constitute a threat to public health and safety. (Introduced 1/7/81; referred to Senate Energy Committee 3/16/82.)

Transportation A-811 Establishes a permit and fee system for transporters of radioactive material.

Permit fees wi'.1 be partially determined by the Commissioner of Health.

Describes information to be submitted when applying for a permit.

Locating Radioactive Gold A-11154, S-8810. Makes an appropriation of

$150,000 for the purpose of locating and disposing of radioactive gold jewelry in the State.

Emergency Plans A-ll697.

Requires the Disaster Preparedness Commission to prepare and provide technical assistance to every city or county in the preparation of plans for evacuation in the event of a radiological accident. (Introduced 3/30/82.)

Transportation S-4510 Prohibits any person from transporting radioactive material over highways in the State without a permit issued by the Commissioner of Transportation. Establishes a permit and fee system.

Describes certain information to be obtained from the shipper before a permit is granted.

Uranium Mining S-8879.

Prohibits all exploration and mining of uranium or other fissionable source materials in the State.
