APPENDIX A NOTICE OF VIOLATION Ponce District Hospital License No. 52-11534-01 As a result of the inspection conducted January 12, 1982, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7,1980), the following violation was identified.

A.

License Condition 19 requires that licensed material be used in accordance with statements, representations, and procedures contained in your appli-cation dated March 29, 1978 and letters received June 11, 1979, and October 15, 1979 and a letter dated July 18, 1980.

Contrary to the above, the licensee did not use its licensed material in accordance with six established procedures (identified below) contained in its application and appurtenant letters.

1.

Although established procedures require daily constancy checks of the dose calibrator, such checks have not been performed since January 1978.

2.

Although established procedures require that records be maintained of quarterly linearity checks of the dose calibrator, such records have not been maintained since January 1978.

3.

Although established procedures require operable survey meters to be available in the Nuclear Medicine Department and that these meters be calibrated annually, such calibration has not been effected on the two survey meters located in the Nuclear Medicine Department.

Furthermore, neither of the survey meters was operable on the date of inspection.

4.

Although established procedures require all incoming packages con-taining radioactive material to be surveyed for radiation levels and contamination, such surveys for contamination have not been performed on molybdenum generators received and neither radiation level nor contamination surveys have been performed on other radioisotope ship-ments received.

5.

Although established procedures require daily surveys of generator elution and dose preparation areas, such surveys have not been per-formed since January 1978.

6.

Although established procedures require the technician to monitor extremity exposure through the use of a ring TLD dosimeter, exposure records indicated that no ring dosimeter has been worn by the tech-nician since July 1980.

B.

10 CFR 35.14(e) requires that sealed sources containing greater than 100 microcuries of gamma emitting material used as calibration or reference sources be tested for leakage and/or contamination at intervals not to exceed six months.

Contrary to the above, the 203 microcurie Cesium-137 sealed source used for calibration has not been leak tested at the required interval since January 1978.

This is a Severity Level IV Violation (Supplement VII).

Pursuant to the provisions of 10 CFR 2.201, you are hereby required to submit to this office within thirty days of the date of this Notice, a written statement or explanation in reply, including: (1) admission or denial of the alleged viola-tion; (2) the reasons for the violation if admitted; (3) the corrective ste";

which have been taken and the results achieved; (4) corrective steps which w be taken to avoid further violations; and (5) the date when full compliance will be achieved. Consideration may be given to extending your response time for good cause shown. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation.
