Dear Administrative Judges:

b On April 2,1982, Intervenor John O'Neill, II, filed with the Board a late request for an order requiring the Staff to answer certain interrogatories which he alleged related to Contention II.C.

Discovery on this contention was opened by the Board for 30 days following a conference call held on March 1, 1982.

The Staff has reviewed these interrogatories and discussed them with Mr. O'Neill. The Staff has agreed to answer interrogatories 1 through 4, 6 through 8, 10, and 11. Mr. O'Neill has modified interrogatory 9 in a way in which the Staff will be able to answer it. With regard to his interrogatories on "grandfathering," the Staff has agreed to answer that portion of the interrogatory relating to modification of NRC regulations.

The Staff has objected to Mr. O'Neill's last interrogatory as too broad and Mr. O'Neill has agreed to further discussions with respect to this interroga tory.

Two options for answering these interrogatories are presently being explored.

April 30, 1982, or will answer them by deposition at a mutually agreeable time and place. Due to the outcome of the discussions described above, the Staff.does not believe that an order concerning this discovery is necessary at this time. This letter has been read to Mr. O'Neill, and he has authorized Staff Counsel to state that he concurs in'its contents.
