Dear Mr. Hiestand:

In your letter of February 22, 1982, you requested an acknowledgment that NFS will not be required to maintain nuclear indemnity insurance during the period that the Department of Energy is in possession of the West Valley facilities pursuant to change No. 31 to License No. CSF-1.

been advised by staff counsel that in the unique fact situation prevailing at West Valley, NFS is not required by law to have and maintain financial protection during the period when the facility is in the exclusive possession of DOE. Accordingly, NRC will not require NFS to maintain financial protection during the period that DOE is in possession of the West Valley facilities pursuant to Change No. 31 to License No. CSF-1.
