NRC STAFF RESPONSE TO AMENDED PETITION OF THE NATURAL RESOURCES DEFENSE COUNCIL FOR LEAVE TO INTERVENE By hemorandum and Order dated April 5,1982, the Licensing Board denied the petition for lease to intervene filed by the Natural Resources Defense Council (NRDC) on March 4, 1982 in this proceeding, The Licensing Board concluded that, based on the allegations contained in its initial petition, NRDC failed to establish a basis for intervention as a matter of right and as a matter of discretion. Memorandum and Order, pg. 4.
However, the Board noted that under 10 C.F.R. 5 2.714(a)(3) an amended petition to intervene could be filed to cure any of the deficiencies in the original petition at any time up to fifteen (15) days prior to the holding of the special prehearing conference I. Id, p. 7, n. 8.

The special prehearing conference is now scheduled for May 5, 1982. Board Notice, dated April 2, 1981.

, i On April 5,1982, NRDC filed an Amended Petition for Leave to Inter-vene.
In the amended petition, NRDC attached an affidavit of an NRDC member who resides in Richland, Washington which is less than twenty (20) miles from the proposed site. The affiant asserts that his residence in close proximity to the site, leisure pursuits, and recreational activities could be adversely affected by the proposed action, and that he has authorized NRDC to represent his interests in this proceeding. Based on this affidavit, the NRC Staff concludes that NRDC has adequately estab-lished standing to be permitted to intervu^ as a matter of right judged by the standards traditionally applied by the NRC in determining the requisite interest in a proceeding. See NRC Staff Response to Petitions for Leave to Intervene Filed by (1) Natural Resources Defense Council, (2) National Wildlife Federation and Oregon Environmental Council, and (3) Coalition for Safe Power /Forelaws on Board, dated March 24, 1982, pp. 3-4.
Accordingly, NRDC should be admitted as a party in this proceeding.
