POWER AUTHORITY'S NOTICE OF APPEAL OF THE ATOMIC SAFETY AND LICENSING BOARD'S ORDER GRANTING INTERVENTION AND DENYING THE POWER AUTHORITY'S REQUEST POR AN EVIDENTIARY HEARING Pursuant to 10 C.F.R. S 2.714a(a) (1981), the Power Authority of the State of New York (Power Authority),

licensee of Indian Point Unit No. 3, hereby notices its appeal l of the Atomic Safety and Licensing Board's order (1) granting intervenor status to the following organizations

1. 'Ihis appeal is being simultaneously filed with the Atcmic Safety and Licensing Appeal Board and the Cmmission. 'Ihe Commission, however, has indicated that interlocutory matters, Memorandum and Order at 2 (Sept. 21, 1981), as wil as the Atomic Safety and Licensing Board's (Licensity3 Board's) final determination, Memorandum and Order at 6-7 (Jan. 8,1981), in this unique investigatory-adjudicatory proceed-irg, are to be presented directly to the Cmmission. / despite their lack of . standing due to the non-existence of membership in those organizations, and the consequent lack of membership control over their acts: Union of Concerned Scientists, the New York Public Interest Research Group, Inc., Parents Concerned About Indian Point, the Westchester People's Action Coalition, Inc., Friends of the Earth, and Rockland Citizens for Safe Energy; and (2) denying the Power Authority's request for a hearing and an opportunity to present evidence regarding that lack of standing and disqualifying conduct by those organizations.
