APPENDIX A NOTICE OF VIOLATION James J. Ball, M.D., Inc.

1319 Punahou Street Suite 1190 Honolulu, Hawaii 96826 License No. 53-13061-01 As a result of the inspection conducted on February 4, 1982, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:

A.

License Condition 14, states that the licensee shall possess and use licensed material in accordance with statements, representations, and procedures contained in application dated October 18, 1978 and letter dated January 16, 1979.

Item 10 of the application dated October 18, 1978, " Calibration of Instruments" states that the dose calibrator shall be checked for linearity on a quarterly basis.

Contrary to the above, the dose calibrator was not checked for linearity between July 19, 1978 and February 4,1982, a period in excess of three years and six months.

This is a Severity Level IV Violation (Supplement VII).

Item 18 of the application dated October 18, 1978, " Waste Disposal Procedures", states that short-lived waste will be stored until it measures less than normal background with a GM detector survey meter after all shielding has been removed.

Contrary to the above, on February 2,1982, a waste log entry indicated that two boxes of radioactive waste were disposed to normal trash with a radiation level of approximately ten times the normal background for the survey instrument being used.

This is a Severity Level IV Violation (Supplement VII).

Item 17 of the application dated October 18, 1978, " Survey Procedures" states that laboratory areas will be surveyed weekly for radiation and contamination levels.

Contrary to the above, at the time of the inspection, contamination wipes and area surveys were being conducted on a monthly basis.

This is a Severity Level IV Violation (Supplement IV).
