Appendix NOTICE OF VIOLATION Veterans Administration License No. 12-02642-06 Lakeside Hospital As a result of the inspection conducted on March 29-31 and April 1, 1982, and in accordance with the NRC Enforcement Policy, 47 FR 9987 (March 9, 1982), the following violation was identified:

l 10 CFR 30.61(a) states: the terms and conditions of each license issued pursuant to the regulations in this part and Parts 31-35 shall be subject to amendment, revision or modification by reason of orders issued in accordance with the terms of the Act.

An order issued on March 12, 1979, amended certain medical licenses to, among other items, maintain for in-spection by the NRC records of the results of each Mo-99 breakthrough test performed. The records shall be maintained for two years following performance of the test.

Contrary to the above, during the past year records of the Mo-99 break-through tests performed were not always maintained. The Mo-99 breakthrough records were not recorded for periods during July, August and November 1981, and January, February and March 1982.

This is a Sch rity Level V violation (Supplement VI).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written state-ment or explanation in reply, including for each item of noncompliance:

(1) corrective action taken and the results achieved; (2) corrective action l

to be taken to avoid further noncompliance; and (3) the date when full com-pliance will be achieved. Consideration may be given to extending your response time for good cause shown.
