Appendix NOTICE OF VIOLATION 1

i Coshocton County Memorial Hospital License No. 34-16739-01 As a result of the inspection conducted on March 18, 1982, and in accord-ance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980),

the following violations were identified:

1.

License Condition No. 16 requires that licensed material be possessed and used in accordance with the statements, representations, and pro-cedures contained in certain referenced applications and letters.

The referenced application dated December 14, 1980, states in Item 17 that procedures contained in Regulatory Guide 10.8, Appendix I, will be followed for routine surveys. Appendix I states that all lab areas will be surveyed weekly including a series of wipe tests to measure I

contamination levels.

Contrary to the above, contamination wipe tests have not been con-ducted in all lab areas since the requirement began on June 4, 1981.

This is a Severity Level V violation (Supplement VII).

10 CFR 71.5 states no licensee shall transport any licensed material outside of the confines of his plant or other place of use, 2

or deliver any licensed material to a carrier for transport, unless the licensee complies with the applicable requirements of Department of Transportation in 49 CFR Parts 170 through 189.

49 CFR 172.403(g)(3) states applicable items of information, including the transport index, must be entered in the blank spaces on the radio-active label.

Contrary to the above, three packages with radioactive yellow II label; were delivered for shipment on February 4,1982, containing Mo99/Tc99m j

generators and the licensee representative stated the transport indexes were not entered as required.

This is a Severity Level V violation (Supplement VII).

I Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written state-ment or explanation in reply, including for each item of noncompliance:

(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full com-pliance will be achieved. Under the authority of Section 182 of the Atomic l
