Dear Administrative Judges:

In accordance with the Licensing Board's Memorandum and Order of September 9, 1981, this letter is to inform the Licensing Board of the discovery activities involving the NRC Staff during the previous two months.

During this period the Staff submitted its partial response to the first set j

of interrogatories from Intervenor Sunflower Alliance and its complete response l

to the second set of interrogatories from the Ohio Citizens for Responsible l

Energy.

In both instances, the responses included production of documents.

During this period Sunflower has also posed two requests for documents to the Staff. The Staff has made a partial response to these requests.

For the l

remaining portion, Mr. Daniel Wilt, Counsel for Sunflower, and I have reached j

an agreement on a more limited definition of what materials should be provided.

The Staff intends in the near future to supplement its response to Sunflower's l

first set of interrogatories and to provide additional documents pursuant to Sunflower's document requests, i

es The Staff expects to publish its Safety Evaluation Report for the Perry Nuclear Power Plant in the first half of May. As the Staff reaches con-clusions in this safety review with regard to issues in controversy in this proceeding, it will be in a better position to seek information from the parties for narrowing the issues. Concurrent with this letter, the Staff is serving its first set of interrogatories upon OCRE and Sunflower.
