r Appendix NOTICE OF VIOLATION Joseph S. Safko, M.D.

License No. 34-13165-01 As a result of the inspection conducted on March 17, 1982, and in accord-ance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980),

the following violations were identified:

1.

License Condition No. 14 requires that licensed material be possessed and used in accordance with the statements, representations, and pro-cedures contained in the application dated February 28, 1979.

Item 10 of this application states survey instruments are calibrated at least annually.

Contrary to the above, a Picker 655-186 GM survey meter used for routine surveying has not been calibrated since November 20, 1980.

This is a Severity Level V violation (Supplement VII).

License Condition No. 12 states that licensed material shall be used by Joseph S. Safko, M.D.

Contrary to the above, on eight occasions in 1981, licensed material was administered to patients and used by a physician not authorized by this license.

This is a Severity Level V violation (Supplement VII).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this of fice within thirty days of the date of this Notice a written state-ment or explanation in reply, including for each item of noncompliance:

(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full com-pliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation. Consideration may be given to extending your response time for good cause shown.
