Dear Judge Carter:

On behalf of the 23 naters of the New York City Council who have been granted

" Interested State" status in the above referred to matter by the Atmtic Safety and Licensing Board in its April 2,1982 Menorandttn and Order, I hereby request an extension of the time period in which we must file formal testinony. We make this request reluctantly because, as public officials, we well recognize the importance of cmpliance with prescribed time schedules. Nonetheless, we are expelled to make this application.

We were represented by pro, bono munsel who filed, on our behalf, our intervenor notions and supporting documentation. As yet, we have been unable to find similiar

~3 counsel to represent us in the hearings phase of the investigation. We share 9 50 the Board's assessnent of the importance of our role in the upccming luarings since without our active participation the point of view of those living in New York City will not be heard. For this reason, we sincerely hope that you and your colleagues on the Atcxnic Safety and Licensing Board will be favorably disposed towards our request for an extension.

Page 2 We believe that no party - neither licensees nor intervenors - will be prejudiced by your granting an extension to us. This is especially so since the section of the evidentiary hearings tdtich will deal with the contentions relating to New York City is the last scheduled.

It is our hope that we will be able to secure counsel surficiently in advance of the New York City portion of the hearings so that neither the Board nor any party will be inconvenier.2d by our difficulty. We further hope that we will have counsel available to participate in the earlier hearing segments as well.
