This is an affirmation / discussion 5 session.

We will ask the Secretary to go over the items S listed.

7 MR CHILKa Okay.

The first item is SECY 8 82-70, Review of ALAB-653 in the matter of Pacific Gas E 9 Electric, where the Commission is being asked to 10 consider an order responding to petitions for review.

11 The order that is before you denies the petition for 12 review.

The paper also asks you to approve a staff 13 requirement memo from the staff requesting information 14 to be used by the Commission in review of the design 15 basis threat.

16 The majority of the Commission has voted for 17 the order denying the petition for review: the Chairman, i

18 Commissioner Ahearne, Commissioner Roberts; Commissioner 19 Gilinsky non-concurs.

The order is subject to the i

20 modification proposed by Commissioner Ahearne.

As I I

21 understand it, the general counsel vill rewrite the 22 order as appropriate.

23 COMMISSIONER GILINSKYs I wonder if you have 24 had a chance to look a t my comments.

3 Rosenthal once pointed out, you have to be careful as to 4 what is allowed to.be present.

5 I have to say somethings that I disagree with 6 Tour interpretation of what the Commission's action is.

No, not what it was at to the time.

I am saying you can draw an inference from 11 what you have said as to what the concurrent 12 Commission's action means, and I disagree with that.

13 COMMISSIONER GILINSKY:

What I said was, what 14 was intended at the time was approved.

15 COMMISSIONER AHEARNE:

I understand that.

16 COMMISSIONEB GILINSKYa We specifically did 17 not want to pick a particular number and we didn't want 18 to have a standard where so many is safe, and if it is 19 one more, it is unsafe.

20 COMMISSIONER AHEARNEa And I cannot disagree.

21 COMMISSIONER GILINSKYa It seems to me that is 22 a feature of the standard that one would want to re tain.

23 COEMISSIONER AHEAENE:

are disagreeing with your 1,nterpretation, because you 2 are saying this interpretation clearly is different.

If it is going to go for a while, I 7 would suggest closing the mweting.

8 CHAIRMAN PALLADIN,0s I have a feeling it is 9 going to go on for a few minutes.

And I have a feeling 10 slso the same thing might be true for the next one.

Let me just say that 13 if I am wrong in my interpretation --

That is all I wanted to 15 say.

I will just put a sentence in tha t I am denying 16 the petition for review, letting the appeal court i

17 decision stand.

And we also have a staff requirement 18 meno out asking f or some inf orma tion.

May I suggest that we 20 vote on closing the meeting?

That is fine with me.
