Confirmation of Action Letter, License No. 39-18727-01 This letter refers to telephone conversations on May 5, and May 7, 1982, between you and Messrs. A. F. Gibson and J. P. Potter of this office, concerning the unauthorized possession and use of your strontium-90 beta eye applicator.
As discussed, your possession and use of the device since September 30, 1980, the expiration date of your license, is in violation of Section 30.3,10 CFR Part 30, inasmuch as a timely renewal was not submitted by you thirty days prior to that date. We understand that following receipt of our letter of June 16, 1981, you misplaced your partially completed renewal application and through oversight, failed to submit the required forms.
Based upon the matters discussed, it is our understanding that you will take the following action:
1.
The beta eye applicator on hand will be placed in a secure storage area until such time as you receive a valid license; no other use of the radio-active material on hand or purchase of additional byproduct material is authorized.
2.
You will have the sealed source tested for leakage and/or contamination by a person authorized by the Commission or an Agreement State as required by your license.
3.
Provide a written report to this office by June 1, 1982, confirming completion of this action including a copy of the leak test result.
Please note that the reporting requirements identified above are not subject to Office of Management and Budget clearance as required by P.L.96-511.
If your understanding of our discussion is different from that stated above, please inform this of fice promptly.
