Dear Mr. Kovacs:
Enclosed is a copy of a Federal Register notice proposing to amend the recordkeeping requirements of the general license in 371.12 of the Cocnission's regulations for transportation of licensed material. This notice is in response to your letter of March 10, 1980, requesting that persons licensed pursuant to 10 CFR 34 for industrial radiography be exenpt from the provision of 10 CFR 71.12(b)(1)(1) requiring that such persons have a copy of "all documents referred to in the license, certificate, or other approval..." in order to be able to deliver licensed material to a carrier for transport under the general licensing provisions of 10 CFR 71.12.
Upon consideration of the actions to be taken by the general licensee to ensure safe shipment of radioactive material, we believe that it is justified to require that the general licensee have for its package those drawings and other documents which deal with use and maintenance of the package and with actions to be taken prior to shipment. This requirement for documents, in place of the requirement for "all" documents which are referred to in the NRC package approval, would be provided by the proposed amendment. The proposed amendment also would provide relief to all users of the general license in g71.12 and not, as you proposed, just to industrial radiography licensees.
As indicated in the Federal Register notice, interested persons are invited to comment on the proposed amendment. At the close of the comment period, the concents will be considered and further action will be taken.
Just what that action will be can only be speculated at this time, nowever, one possibility is that a final amendment would be issued which closely resembles the enclosed proposed amendment. Since such action would, in y //
