AFFIDAVIT OF GERMAIN LAROCHE, PH. D.

I, Germain LaRoche, being duly sworn, state as follows:

1.

I am a Senior Land Use Analyst in the Environmental Engineering Branch, Office of Nuclear Reactor Regulation, U.S. Nuclear Regulatory Commission. A statement of my profession;l qualifications is attached.

2.

As a Senior Land Use Analyst, I am responsible for the review and evaluation of potential power plant impacts on land use and terrestrial resources.

On May 17, 1982 I inspected the site for the Black Fox nuclear power plant to determine the environmental impact thus far imposed onsite_

'and to evaluate the potential environmental impact on and off the site of abandoning construction of the plant.

I paid particular attention to those areas specifically affected to date by site preparation and plant construction activities.

These are:

(1) central plant excavation, (2) waste-water holding pond, (3) engineered drainage system, (4) river banks, (5) railroad and roadway rights-of-way, (6) construction buildings, and (7) barge slip.

I observed that the inclined exposed banks along the barge slip and the RPV haul road have not naturally revegetated and that some soil erosion is occurring.

As a consequence, soil is washing directly into the barge slip which opens into the Verdigris River.

I also observed erosion along the edges of the inclined RPV haul road leading from the barge slip area.

I also observed areas of the engineered drainage system, the area surrounding the helicopter pad, and areas along the access roadway and the railroad rights-of-way, which were disturbed during site preparation and plant construction activities and have not yet completely revegetated.

Some soil erosion is occurring from these areas.

In my opinion a requirement to stabilize the soils in the areas identified in paragraphs 4 and 5 above where erosion has occurred will provide adequate protection for the site and the surrounding area from detrimental environmental impacts of site preparation and plant construction activities.

7.

This is true and correct to the best of my knowledge and belief.

s PROFESSIONAL QUALIFICATIONS Dr. Germain LaRoche U.S. Nuclear Regulatory Cornission Washington, D.C.

As a Land Use Analyst in the Terrestrial Resources Section of the Environmental Engineering Branch of the Division of Engineering, USNRC, I evaluate the potential environmental impact on terrestrial ecosystems and land use.

Prior to being employed by the NRC I was director of Terrestrial kcology for a private consulting firm for three years.

In this capacity I directed and conducted baseline studies of proposed nuclear or fossil fuel power plants, and large urban and recreational developments.

For ten years I taught at colleges, attaining the rank of Associate Professor of Biology. The e colleges were:

Empire State College, Albany, N.Y.; State University College at New Paltz, N.Y.; Manhattan College and Bronx Community College, Bronx, N.Y.;

and Holyoke Community College, Holyoke, Massachusetts. Among the graduate

and/or undergraduate courses I taught were Ecology, Plant Physiology, Plant Taxonomy and General Biology.

I have also conducted forest and range manage-ment research with the U.S. Forest Service in Florida for 2 years.

I received the Ph.D degree in Botany-Plant Ecology from the University of lassachusetts at Amherst in 1969, the M.S. in the same areas from The Catholic University of America in Washington, D.C. in 1958, and the B.A. in Biology from The Catholic University of America in 1957.

In 1950 I graduated from the Stockbridge School of Agriculture of the University of Massachusetts as a

Floriculture major.
