May 28, 1982 EN 82-17 0FFICE OF INSPECTION AND ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Portland General Electric Company Docket No. 50-344 Trojan Nuclear Power Plant

Subject:

PROPOSED IMPOSITION OF CIVIL PENALTY - $60,000 This is to inform the Commission that a Notice of Violation and a Notice of Proposed Imposition of Civil Penalty in the amount of Sixty Thousand Dollars

($60,000) will be issued to the Portland General Electric Company on or about June 3, 1982. This action is based on one violation concerning the failure to complete corrective action on an identified deficiency which would, under certain conditions, render one emergency diesel inoperable.

This deficiency was identi-fied in May 1977 at which time standing orders were issued declaring the emergency diesel inoperative when these conditions existed.

In July 1981 a revised stcnding order was issued eliminating the reference to the original deficiency. The defi-ciency had not been correci.ed. As a result, one emergency diesel was inoperable when required for approximately 36 days with no action initiated by the licensee to perform specified surveillance or to commence a shutdown of the facility.

A news release will be issued about the time the licensee receives the Notice.

The State of Oregon will be notified.

It should be noted that the licensee has not been specifically informed of the enforcement action. The Regional Administrator is signing this action. The schedule of issuance and notification is:

Mailing of Notice June 3, 1982 Telephone Notification of Licensee June 3, 1982 The licensee has 30 days from the date of the Notice in which to respond.

Following NRC Staff evaluation of the response, the civil penalty may be remitted, mitigated or imposed by Order.
