SUBJECT:

PROPOSED LICENSE TO EXPORT DEPLETED URANIUM BARST0CK TO CANADA (XUO8545)

On May 19,1982 Nevada Engineering and Technology Corporation (NETCO) applied for a license to export 2,750 kilograms of bulk depleted uranium alloy to Canada for use in the production of the Phalanx CIHS penetrators.

v NETC0 has requested expeditious processing of this license request as the material is currently ready for immediate shipment.

Apparently the Company has experienced serious delays in performance of its contract.

Depleted uranium for a non-nuclear end use is not subject to the export licensing criteria contained in 10 CFR 110.42 and may be made without being subject to an Agreement for Cooperation.

Such material falls within the categories of exports listed under 10 CFR 110.41(d) which are not normally reviewed by the Executive Branch.

Under 10 CFR 110.40(b), proposed exports of source material are not normally reviewed by the Commission.

The staff notes the material will be reexported to the United States by Canada for further processing. When the depleted uranium is in final fabricated form for use in munitions, an export license will be required from the Department of State, Office of Munitions Control.

The staff has concluded that the proposed export meets the requirements of the Atomic Energy Act, as amended, and would not be inimical to the common defense and security of the United States.

In view of the above considerations, the staff is the license without the normal 15-day waiting period.
