1, APPENDIX NOTICE OF VIOLATION i

i Ford, Bacon and Davis Utah, Inc.

Docket: 30-1911E License: 43-19698-01 As a result.of the inspection conducted on May 3, 1982, and in accordance with the NRC Enforcement Policy (10 CFR Part 2, Appendix C), 47 FR 9987 (March 9, 1982), the following violations were identified:

1.

License Condition 10 states that licensed material may be used at the l

licensee's facilities at 375 Chipeta Way, Salt Lake City, Utah, and at.

temporary job sites anywhere in the State of Utah.

Contrary to this requirement, licensed material was permanently stored and in use at 505 Wakara Way, Salt Lake City, Utah, as stated by the licensee on May 3, 1982.

This is a Severity Level IV violation (Supplement VI.D.2).

License Condition 13 states that sealed so'urces containing licensed material shall not be opened or removed from the^ portable gauges by the licensee.

Contrary to this requiremen't,'the licensee-stated that a source was removed from a gauge when. conducting certain gauging operations during 1981 and 1982.

This is a Severity Level IV violatioE'(Supplement VI.D.2).

License Condition 14.A(1) requires,;in part,1that sealed sources shall be tested 'for leakage and/or contamination at ' intervals not to exceed i

l Contrary to this requi ement, a C'ampbell Pacific gauge, model MC-2, serial i

Number M20123587, containing a 10 millicurie cesium-137 sealed source and a 40 millicurie americium-241' sealed source was not tested during the period February 2,1981, to January 20, 1982.

This is a Severity Level IV violation-(Supplement VI.D.1).

10 CFR 19.11(a) and (b) require that each licensee shall post current copies of specified regulations and the license or a notice specifying where such documents may be examined.

Contrary to this requirement, neither the documents nor a notice were posted on May 3, 1982.

This is a Severity Level V violation (Supplement VI.E).

10 CFR 19.11(c) requires that Form NRC-3 '" Notice to Employees" shall be posted by each licensee wherever individuals work in or frequent any portion of a restricted area.

Contrary to this requirement, a Form NRC-3 was not posted on May 3,1982.

This is a Severity Level V violation (Supplement VI.E).

10 CFR 30.51 requires, in part, that each licensee shall keep records showing the receipt, transfer, and disposal of byproduct material.

Contrary to this requirement, no records were available on May 3,1982, for the transfer of a Campbell Pacific gauge, model MC-2, serial Number M20123587, containing 10 millicuries of cesium-137 and 40 millicuries of americium-241 during 1982.

This is a Severity Level V violation (Supplement VI.E).

Pursuant to the provisions of 10 CFR 2.201, Ford, Bacon Davis Utah, Inc.,

is hereby required to submit to this office, within 30 days cf the date of this Notice, a written statement or explanation in reply, including:

(1) the corrective steps which have been taken and the results achieved; (2) tne corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved.

Consideration may be given to extending your response time for good cause shown.
