RESPONSE OF GREATER NEW YORK COUNCIL ON ENERGY TO POWER AUTHORITY'S BRIEF SUPPORTING APPEAL OF ATOMIC SAFETY AND LICENSING BOARD'S ORDER GRANTING INTERVENTION The Greater New York Council on Energy (GNYCE) hereby responds in opposition to PASNY's appeal of the ASLB's Aptil 23, 1982 Order granting intervenor status to GNYCE.

I.

GNYCE HAS ESTABLISHED STANDING TO INTERVENE AND RAISES ISSUES PROPERLY CONSIDERED IN THIS PROCEEDING.

The ASLB in this proceeding has correctly recognized the triviality of PASNY's arguments that GNYCE lacks standing to intervene.

regard to GNYCE's standing, this was resolved when j

GNYCE supplied affidavits of membership and appropriate i

authorization pursuant to the ASLB's directive at the I

December 2, 1981 Special Prehearing Conference.

Based i

I upon these submissions the Board granted GNYCE standing.

In spite of this, PASNY simply reiterates its original t

I objection.

I GNYCE's participation in this proceeding has been, and will continue to be, completely constructive for the i

efficient development of a full record on the Commission's six questions.

Even Consolidated Edison has recognized i

the appropriateness of issues raised by GNYCE.

GNYCE CANNOT BE DENIED INTERVENOR STATUS ON THE GROUND i

THAT IT HAS PREVIOUSLY MADE STATEMENTS CRITICAL'OF NUCLEAR POWER.

r Even if GNYCE had made all the statements that PASNY erroneously attributes'to it, there is no legal ground Only the long quotation on the middle of page 3 of PASNY's Brief was in fact made by GNYCE. -The,other attributions are erroneous.-

ror excluding an intervenor because of its publicly expressed belief that nuclear power is not in the public interect.

PASNY's attempt to exclude GNYCE is a naked appeal to bias that should be perceived as an insult to the Commission.

Having struggled in vain to discover constitutional infirmities in the Commission's Orders setting forth this proceeding, PASNY now beseeches the Commission to create a constitutional infirmity by reversing the Board's acceptance of GNYCE as an intervenor.

To exclude GNYCE because it has publicly criticized nuclear power would of course violate the First Amendment of the U.S.

Constitution.

CONCLUSION Because PASNY's arguments against GNYCE's participation in the hearings have no merit whatever, PASNY's appeal should be promptly dismissed.
