SUBJECT:
DESIGN SECTION OF 10 CFR PART 60 The WMHT Branch and the WMHL Branch have reached agreement on the design requirements for 10 CFR Part 60 as indicated in the April 15, 1982 memo from Hubert Miller to you, " Review of Final 10 CFR Part 60, Draft Supplementary Information, and Responses to Public Comments on Proposed Rule".
As indicated to you previously, the WMHT Branch prefers the format for the design section that was developed by WMHT and WMHL rather j
than the RES version dated April 5, 1982.
This preference is based on the following:
1)
The NMSS version follows the original format of the propssed rule.
There is no clear rationale in the RES version for altering from the original format.
The changes that were made to the rule involved specific subsections of the design requirements and not the design section as a whole, and therefore, a reorganization of the design requirements is unneccessary.
The commentors may not recognize the design

The RES version does not make a distinction between general design requirements and design requirements that pertain only to systems, structures, and components that are important to safety.
3)
Some of the design requirements pertain to both pre-closure and post-closure of the repository.
The RES format of pre-closure requirements and post-closure requirements would force repetition of some requirements under both headings.
This kind of repetition in unneccessary.
Based on the above problems in the RES version of the design requirements for 10 CFR Part 60, the WMHT Branch suggests the use of the design requirements as agreed upon between WMHT and WMHL.
