Subject to the availability of. appropriations,

the Nuclear Regulatory Commission agrees to indemnify and hold harmless USEcology, Inc.
against all claims, losses and expenses on account of Personal or property damage arising out of or in connection with the activities of the Brookhaven National Laboratory at the Sheffield, Illinois low level waste facility, unless such claim, loss or expense is caused directly by wilful misconduct or gross negligence on the part of USEcology, Inc. or the State of Illinois.
