On July 2,1976, the Humboldt Bay plant was shutdown for replacement of some of the fuel in the core. By order dated May 21, 1976, the NRC required that before resuming operation, the Pacific Gas and Electric Company (the Itcensee) complete certain activities. The licensee was required to upgrade, as necessary, the seismic capability of safety-related equipment (e.g. the reactor coolant pressure boundary) to current requirements, and to resolve more recent seismic concerns having to do with earthquake vulnerability that had arisen since the time an operating license was issued on August 29, 1962.

Although the licensee has undertaken extensive geological investigations and completed some plant modifications, the licensee has not yet decided to provide the NRC with the required technical information for its review to justify resumed operation. Until the licensee decides to do so, and we complete a safety review, we consider that the Humboldt Bay plant does not meet the Commission's regulations and if operated in its current condition, would present an undue risk to the health and safety of the public.

In the meantime the NRC staff considers that the Humboldt Bay plant presents no undue risk to the health and safety of the public, as long as it remains in its present shutdown condition.

I have attached a recent letter written to the Atomic Safety and Licensing Board from the staff which provides more technical detail in support of this conclusion.
