APPLICANT'S MOTION FOR PROPOSED SCHEDULE FOR FURTHER PROCEEDINGS 1.
At the prehearing conference held in the above-entitled matter on August 11, 1981 (Tr. 165-66) counsel for the applicant agreed to attempt, after issuance of the pre-hearing conference order, to obtain the agreement of all parties with respect to, and to propose, a schedule for further proceedings herein.
2.
On April 12, 1982 a comprehensive memorandum and order was issued by the Board.
3 Since that time, applicant's counsel has attempted t
l without success to obtain agreement of all parties as to scheduling.
Agreement has been possible only with the Staff and Maine.
4.
The schedule upon which the Staff, Maine, and appli-cant have agreed is set forth in Attachment A hereto.
Assum-3 ing issuance of the EIA and SER by May 31, 1982, this schedule D23 l
JD 8205240091 820517 I
PDR ADOCK 05000309 C
would call for the matter to be ready for evidentiary hear-ings in February of 1983.
5 SMP has advised counsel for the applicant that it would want discovery not to commence until all contentions (including any late-filed contentions) are ruled upon by the Board.
SMP also wants the discovery period to run for 180 days thereafter.
This would result in a hearing being held ir. June of 1983 assuming the rest of the schedule was adhered to.
WHEREFORE the Applicant moves the Board to adopt the schedule set forth as Attachment A hereto.
