r Appendix NOTICE OF VIOLATION Mercy Hospital License No. 34-18776-01 As a result'of the inspection conducted on April 22, 1982, and in accordance with the NRC Enforcement Policy, 47 FR 9987 (March 9, 1982), the following violations were identified:

License Condition No. 16 requires that licensed material be possessed and used in accordance with statements, representations, and procedures contained in the application dated July 25, 1979.
This application states in Item No. 10 that Regulatory Guide 10.8, Appendix D procedures will be followed for the dose calibrator cali-brations. Appendix D states linearity checks will be conducted quarterly.
Contrary to the above, linearity checks were not performed on the dose calibrator from May 4, 1981, to December 21, 1981.
This is a Severity Level V violation (Supplement VI).

License Condition No. 16 requires that licensed material be possessed and used in accordance with statements, representations, and procedures contained in the application dated July 25, 1979.
This application states in Item No. 19 that surveys of therapy patient's rooms will be conducted after administration of the treatment dose and before the room is reassigned.
Contrary to the above, on January 11, 1982, a survey was not performed of a therapy patient's room after administration of the dose nor before the room was reassigned.
This is a Severity Level IV violation (Supplement VI).
Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written state-ment or explanation in reply, including for each item of noncoaipliance:
(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full com-pliance will be achieved. Consideration may be given to extending your response time for good cause shown.
