i APPENDIX A NOTICE OF VI'0LATION Elkem Metals Company License No. 47-19784-01 As a result of 'th'e. inspection conducted on February 3,.1982, and in accordance with the' Interim Enforcement. Policy, 45 FR 66754 (October 7,1980), the following violation was identified.
-10 CFR.20.105(b)(1) requires in part that no licensee shall possess or use licensed material in such a manner as to create _in any unrestricted area, radiation levels which, if an individual were continuously present in the i
area, could result in his receiving a dose in excess of two' millirems in any one hour.
Contrary to the above, radiation levels up to 3.3 millf rems per hour were 4
measured in unrestricted. areas. around level measurement gauges mounted on your #3 and #5 furnaces. These areas are considered unrestricted as they do not meet the description of restricted area contained in 10 CFR 20.3(a)(14).

Pursuant to the provisions of 10 CFR 2.201, you are hereby required to submit to this office within thirty days of-the date of this Notice, a written statement or explanation in reply, including:. (1) admission or denial.of the alleged viola--
-tion; (2) the reasons for the violation if admitted; (3) the corrective steps c
which have been taken and the results achieved; (4) corrective steps which will be taken to' avoid further violations; and (5) the date when. full _ compliance will be achieved. Consideration may be given to extending your response time for: good-cause shown.. Under the authority of Section 182 of the Atomic' Energy Act. of 1954, as amended, this response shall be submitted under oath or. affirmation.
