BOARD'S ORIER GRANTING INIERVENTION T,\ \s AND DENYING REQUEST FOR EVIIENTIARY k (p HEARING ON ISSUES OF STANDING Vi?-[T3 In accordance with this Board's Memorandum and Order of January 11, 1982, Parents Con rned About Indian Point, the Union of concerned Scientists and the New York Public Interest Research Group, Inc. hereby notify the Board that they do not intend to respond to PASNY'S attempt to appeal the Order of April 2,1982 that granted standing to intervene. Rather, the Ccmnissioners and the Appeal Board are respectfully referred to the responses to the same objections raised by PASNY on the questions of standing filed by 03 Parents on Decenber 10, 1981, by UCS on December 10, 1981 and by NYPIRG on s

Decenber 8,1981.

!! 'Ib the extent that PASNY attenpts to raise in its appeal the unrcolved 8205140136 820507 PDR ADOCK 05000247 O PDR -

i red herring of the " fear-nongering" of intervenor groups, the Ocmnissioners and the Appeal Board are referred to the responses to the sane subject filed by UCS, NYPIIG and PARENIS jointly on Decenter 17, 1981.

PASNY apparently attenpts to rhift the focus of inquiry away fra the safety of Indian Point Unit 3 to nenbership policies of intervenors; while refusing to subnit a detailed statement of position on the safety of its plant, as the Atmic Safety and Licensing Board requested at the 1

Decenber 2,1981 special pre-hearing conference, PASNY continues to take every opportunity to prevent the investigation fr m taking place at all.
