4 Purpose and Summary g

On March 4,1982, WMUR staff took the opportunity of being in Denver on other business to briefly meet with the above listed' individuals to discuss NRC's involvement in the upcoming hearings to be held on the proposed Pioneer Uravan project. The proposed project involves a 1000 ton per day conventional uranium mill to be located in the vicinity of Slick Rock, Colorado.

NRC provided technical assistance to the State of Colorado in the review of this project in 1980. The technical assistance report took the fonn of an environniental assessment which included an evaluation of the proposed tailings management program as weli as a radiological assessment.

The hearings on the proposed project are scheduled for March 22, 23, and 24, 1982, in Norwood, Colorado.

The hearing officer will be Bob Arnault from the Colorado Department of Health. According to Colorado regulation, the burden of proof at the hearing rests with the applicant. Al Hazle, Jake Jacobi and a representative from the Water Quality Control Commission will sit on a back-up panel to question witnesses for purposes of clarification of the record. Other State staff and consultants (including NRC representatives) will be in attendance to 1) aid in cross examination of witnesses, 2) appear as rebuttal witnesses in the event the State considers it appropriate to place additional evidence in the record, and 3) be available to other parties to the proceeding who may wish to question staff and/or consultants concerning their review of the proposed project.

The State has scheduled a prehearing conference for March 8,1982, at which parties (i.e., individuals or organizations having applied for official party status) will be required to provide all other parties, the applicant, and the Department with prehearing statements containing a brief sumary of factual and legal claims, and the basis therefore, as well as a brief statement of the testimony they will present. Those organizations which have already applied for official party status include:

Sierra Club, Colorado Open Space Council; and National Wildlife Federation.

Interested persons without party status will also be permitted to present oral comments at the public hearing.

The State has transmitted its formal request for NRC participation in the hearing and NRC has agreed to this request with participation obviously being limited to the scope of the NRC assessment. The State also requested that NRC be available to meet on March 21, 1982, to review in detail (with the benefit of information obtained at the prehearing conference) the roles of each individual involved and the specific areas in which they may be called upon to respond to questions or present evidence.
