Appendix NOTICE OF VIOLATION Environmental Protection Agency License No. 22-13390-01 As a result of the inspection conducted on April 8,1982, and in accordance with the NRC Enforcement Policy, 47 FR 9987 (March 9, 1982), the following violations were identified:
1.
License Condition No. 14 requires you to test each chromatograph detector cell containing nickel-63 for leakage and/or contamination at intervals not to exceed six (6) months.
Contrary to the above requirement, it was determined through the NRC inspector's review of leak test records that this requirement was not met.
Specifically, detector cell serial No. 1506 was last Icak tested in December 1980 and detector cell serial Nos. 3819, 3443, and H-2133 were last leak tested in July 1981.
This is a repeat item of noncompliance.
This is a Severity Level V violation (Supplement VI).
2.
License Condition No. 22 requires that. licensed material be possessed and used in accordance with statements, representation, and procedures contained in application dated March.27, 1980 and other referenced documents.
Supplement E of the above application states that the Eberline MS-3 survey meter will be recalibrated every year.
Contrary to the above, the Eberline MS-3 survey meter has not been calibrated since' January 1981, a period in excess of one year.
This is a Severity Level V violation (Supplement VI).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement' or explanation in reply, including for each item of noncompliance:
(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full compliance will be achieved.
Consideration may be given to extending your response time for good cause shown.
