Gentlemen:
Consumers Power Company was notified by the NRC Staff on Friday, April 23, 1982 that they were filing a motion to defer the June 7 hearing in this case.
We understand that as of the close of business April 29, the NRC Staff now intends to seek a time extension of the May 7 testimony filing date with respect to several issues.
No motion has been filed by the NRC Staff, and counsel has been advised that the motion will be filed by either Monday, May 3 or Tuesday, May 4.
The dilatory tactics of Staff counsel are seriously prejudicing the ability of the parties to respond prior to May 7.
It is the purpose of this letter to advise the Board that Consumers Power Company intends to oppose the Staff's motion in whole or in part depending upon the final version of the motion.
